1. Acceptance of Terms
By accessing or using Digital Catapult's website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services
Digital Catapult provides restaurant marketing services including but not limited to: Zomato & Swiggy optimization, menu engineering, food photography, ad management, review management, and analytics consulting.
3. Client Obligations
Clients must provide accurate restaurant information, timely access to platform accounts when required, and cooperate in good faith. Any delays caused by incomplete information may affect service timelines.
4. Payment Terms
Fees for services will be communicated before engagement. Payments are due as per the agreed schedule. Late payments may result in suspension of services. All fees are non-refundable unless stated otherwise in the Refund Policy.
5. Intellectual Property
All content, strategies, reports, and materials created by Digital Catapult remain our intellectual property unless explicitly transferred. Clients may not reproduce, distribute, or resell our proprietary materials.
6. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the engagement, including business data, strategies, and performance metrics.
7. Limitation of Liability
Digital Catapult shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the fees paid for the specific service in question.
8. No Guaranteed Results
While we employ proven strategies, we do not guarantee specific results such as order volumes, ratings, or revenue increases. Performance depends on multiple factors including market conditions and platform algorithms.
9. Termination
Either party may terminate the engagement with 15 days written notice. Upon termination, any outstanding fees become immediately due. We will provide all deliverables completed up to the termination date.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in the relevant Indian jurisdiction.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
